Is Probate Necessary in New York State?

Probate is not necessary for all situations in New York, but it is required in some. If there is a will and the estate is valued at over $30,000, then probate is necessary. However, if the estate is valued at less than $30,000, then the courts will hold a “small estate proceeding” instead. Additionally, if an estate does not have a will, then the estate is “administered”, not probated.

The following are assets that are not subject to probate:

  • Insurance policy proceeds
  • Retirement accounts (401K, IRA, etc.)
  • Other accounts with a named beneficiary

How Long Does Probate Take in New York?

It is impossible to say how long each probate process will take in New York because it will differ depending on the circumstances. However, on average, the probate process takes 7-9 months in New York.

If all the beneficiaries are in full agreement regarding the asset distribution, the probate process will be simplified. However, if there is a disagreement amongst the parties, the process could become more complex as litigation may be involved.
