Legal retirement planning coordinates the documents, beneficiary arrangements, asset-protection measures, and care considerations that can affect your savings and personal wishes. We address legal decisions involving retirement accounts, estate planning, Medicaid eligibility, and future care.
Financial and legal planning serve different functions. Financial professionals may address investments, projected income, and tax strategy. We focus on documents, legal rights, benefit eligibility, and the legal consequences of estate and retirement decisions. When financial or tax questions arise, clients may need to coordinate our guidance with their financial and tax professionals.

Coordinating Retirement Accounts with Your Estate Plan
IRAs, 401(k)s, and pensions commonly use beneficiary designations to direct remaining funds after the account owner dies. A beneficiary designation generally controls the distribution of that account, even when a will contains different instructions. Reviewing these forms with the rest of the plan can reveal conflicting directions or arrangements that no longer reflect the owner’s wishes.
We create wills, trusts, powers of attorney, and health care proxies as part of our elder law services. A power of attorney authorizes a selected agent to handle financial matters when the person granting authority can’t act. A health care proxy appoints an agent to make health care decisions under the circumstances stated by New York law and the document.
Our work also includes beneficiary rights, distribution of assets, estate administration, probate, and estate-tax matters. We consider each client’s family circumstances, assets, existing documents, and intended beneficiaries when developing an individualized legal strategy.
Planning for Long-Term Care in Nassau County
Nursing home or assisted living care may cost upward of $10,000 each month. Our life care planning combines care coordination and asset protection, while our broader elder law practice addresses Medicaid and related concerns. The appropriate approach depends on the person’s health, care setting, income, resources, marital circumstances, and planning history.
Key 2026 New York long-term-care Medicaid figures include:
- The general resource limit is $33,038 for an individual and $44,796 for a married couple when both spouses apply.
- The monthly income limit is approximately $1,836 for an individual and $2,489 for a married couple when both spouses apply.
- A community spouse can generally retain between $74,820 and $162,660 under the Community Spouse Resource Allowance.
- The Minimum Monthly Maintenance Needs Allowance permits a community spouse to retain income of up to $4,066.50 per month.
Retirement accounts that aren’t in payout status generally count as assets when determining New York Medicaid eligibility. Accounts in payout status are generally exempt when the owner takes at least the required minimum distributions. These classifications are only part of the analysis, so eligibility can’t be determined from resource or income figures alone.
Retirement Income & New York Estate Taxes
Required minimum distributions can increase a retiree’s taxable income. Some people also consider converting traditional retirement funds to Roth IRAs as part of broader retirement and tax planning. We don’t provide investment management or tax advice, but we can address how these decisions intersect with trusts, asset distribution, and the structure of an estate plan.
New York estate-tax rules may require additional planning for larger estates. For deaths occurring from January 1 through December 31, 2026, the state’s basic estate-tax exclusion is $7,350,000. An estate exceeding 105% of that amount, or $7,717,500, loses the exclusion and is taxed on its full value rather than only the amount above the exclusion.
New York doesn’t permit spouses to transfer an unused estate-tax exclusion to one another through portability. Each spouse has an individual $7,350,000 exclusion in 2026. We provide individualized legal guidance involving estate taxes, trusts, estate administration, and asset distribution. Tax professionals can advise on the tax consequences of a proposed financial decision.
